Florida Judge Fist Fights with Public Defender

The Florida Supreme Court has removed a Brevard Court judge from his position for "appalling behavior" after he threatened and physically attacked a public defender outside the courtroom, which was captured on video. The court overturned the Florida Judicial Qualifications Commission's recommendation of a 120-day suspension, a $50,000 fine, a public reprimand, and mental health therapy for Judge John C. Murphy, ruling that he was not fit to serve as a judge after the June 2, 2014 incident with assistant public defender Andrew Weinstock. Murphy's prior judicial performance was disregarded, and his removal from office was deemed appropriate due to the erosion of public confidence in the judiciary caused by his misconduct.


 During the disciplinary hearing, Murphy submitted a Veterans Affairs finding that he suffered from post-traumatic stress disorder from his service in Afghanistan, but the court noted the possibility of future misconduct given the severity of his behavior. Brevard County Chief Judge John D. Galluzzo expressed his wishes for Murphy's future success, stating that his removal from office should not significantly disrupt court services.
